(FCT) is responsible for the development and maintenance of technological areas within the communications infrastructure and advanced services related to research, science, and education.<\/p>\n<p>As an administrative entity with significant responsibilities in the fields of scientific research, technology, and innovation across all areas of knowledge, FCT is committed to respecting the principles applicable to data protection and to strengthening the legal safeguards of personal data subjects, in strict compliance with the applicable legislation\u2014specifically, Article 35 of the Constitution of the Portuguese Republic; Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation \u2013 GDPR); Law No. 58\/2019 of 8 August, which ensures the implementation of the GDPR in the national legal order; and Law No. 59\/2019 of 8 August, which approved the rules on the processing of personal data for the purposes of the prevention, detection, investigation, or prosecution of criminal offences or the execution of criminal penalties.<\/p>\n<p>In carrying out its responsibilities, FCT is an integral part of the measures implemented under the current scientific policy framework defined across the European Union, with a particular focus on open science and science management.<\/p>\n<p>With this overarching goal, PTCRIS was launched as the structural program for the management of science and technology, aiming to promote the integration of various information systems that support scientific activity and are used by researchers, science managers, and the general public.<\/p>\n<p>As part of PTCRIS, the implementation of a national registry of science and technology funding (SciPROJ) was developed. This registry integrates a national database that aggregates, in a single location, all funding records (national and international) that support science and technology activities carried out in Portugal.<\/p>\n<p>SciPROJ provides access to funding references relating to:<\/p>\n<ul>\n<li>Funding awarded<\/li>\n<li>Funding executed<\/li>\n<\/ul>\n<p>Structured into four major groups (funding, people, projects, and institutions\/organizations), SciPROJ provides information on:<\/p>\n<ul>\n<li>Funding allocated to individuals, projects, and institutions;<\/li>\n<li>Funding entities that awarded the funding;<\/li>\n<li>Consortia of institutions\/organizations where science and technology activities took place with execution of the respective funding;<\/li>\n<li>Research teams.<\/li>\n<\/ul>\n<p>The information is stored on this platform, accessible at <a href=\"https:\/\/sciproj.ptcris.pt\/en\/\">https:\/\/sciproj.ptcris.pt<\/a>t, and includes personal data. Therefore, the processing of such data complies with the principles required by the GDPR and other applicable legislation.<\/p>\n<p>In this context, the present Privacy Policy aims to inform how FCT processes data within the scope of the SciPROJ project, for what purposes, with whom the data is shared, the retention period, the different ways users may contact FCT to understand and exercise their rights, and the technical and organizational measures implemented to ensure data protection.<\/p>\n<h2>Data Controller<\/h2>\n<p>FCT, headquartered at Av. D. Carlos I, 126, 1249\u2011074 Lisbon, telephone: +351 21 392 4300, acts as the data controller for the personal data processed within the scope of the SciPROJ project.<\/p>\n<h2>Data Protection Officer<\/h2>\n<p>A FCT designou uma Encarregada de Prote\u00e7\u00e3o de Dados, cujo contacto deve ser efetuado diretamente atrav\u00e9s do e-mail <a href=\"mailto:dpo&#64;fct&#46;pt\">&#x64;&#x70;&#111;&#064;&#102;c&#x74;&#x2e;&#x70;&#116;<\/a> sobre todas as quest\u00f5es relacionadas com o tratamento dos dados pessoais tratados ao abrigo desta Pol\u00edtica de Privacidade.<\/p>\n<h2>Collection of Data, Categories of Data Subjects, and Categories of Data<\/h2>\n<p>The data recorded in the SciPROJ database is, for the most part, obtained from publicly accessible third\u2011party systems, namely the funding entities that issue the records, including FCT itself.<\/p>\n<p>In this context, personal data is processed both when collected directly and indirectly from the respective data subjects. In all cases, only personal data deemed appropriate, relevant, and not excessive is processed, strictly for the specific, explicit, and legitimate purposes for which it is intended.<\/p>\n<p>The collected data concerns the following categories of data subjects: researchers, teaching staff, users of higher education institutions, students, and scientific staff involved in the Portuguese scientific system.<\/p>\n<p>The collected data concerns the following categories of data:\n\nIdentification data (name, gender, date of birth, nationality, and unique identifiers such as Ci\u00eancia ID and ORCID)\n\nContact data (email address)\n\nEducation, training, and employment data (job titles and employment history)\n\nFinancial data (salary)\n\nAuthentication data (access profile to the data registry)\n\nTracking data (access logs)<\/p>\n<h2>Purpose of the Processing of Personal Data<\/h2>\n<p><strong>Personal data is collected for specific, explicit, and legitimate purposes and may not be further processed in a manner incompatible with those purposes.<\/strong><\/p>\n<p>The personal data processed through the SciPROJ platform is intended for the management and development of digital infrastructures for the registration and analysis of data related to science, technology, and research and development (R&amp;D) activities.<\/p>\n<p><strong>Some personal data may subsequently be processed for purposes of archiving in the public interest, scientific or historical research, or statistical purposes. Such processing is not considered incompatible with the initial purposes, in accordance with Article 89, n.\u00ba1 of the GDPR.<\/strong><\/p>\n<h2>Lawful Basis for Processing<\/h2>\n<p>The processing of personal data within the SciPROJ project complies with the principles of lawfulness, fairness, transparency, and storage limitation. Its lawful basis, for the purposes of Article 6 of the GDPR, is set out in point (e), as the processing is necessary for the performance of tasks carried out in the public interest and inherent to FCT\u2019s mission and responsibilities, as established in Decree\u2011Law No. 55\/2013 of 17 April, which defined FCT\u2019s mission and responsibilities, and in Ordinance No. 216\/2015 of 21 July, which approved its statutes.<\/p>\n<p>Specifically, the lawfulness of this processing is reinforced by FCT\u2019s obligation to comply with Decree\u2011Law No. 63\/2019 of 16 May, which establishes the legal framework for institutions dedicated to research and development (R&amp;D) and other actors within the national science and technology system. It defines the general principles for evaluation and funding and regulates the valorization, access, and dissemination of knowledge.<\/p>\n<p>This legal framework identifies as one of its main objectives the need to \u201cprovide a system for the registration and analysis of data on science and technology, covering human resources, institutions, scientific activity and output, projects, programs, and funding, in accordance with international best practices and European reference standards.\u201d<\/p>\n<p>This objective is aligned with recommendations issued by the Organisation for Economic Co\u2011operation and Development (OECD), particularly regarding the implementation of rules for access to publicly funded research data and the improvement of data access and sharing.<\/p>\n<p>For SciPROJ, a key OECD recommendation addressed to Member States\u2014including Portugal\u2014emphasizes the development and implementation of coordinated mechanisms, strategies, or policies to ensure that research data and other digital objects relevant to publicly funded research are openly accessible and reusable to the greatest extent possible, while considering the need to restrict access to protect legitimate private, public, and community interests.\n\nWhen developing and implementing such mechanisms, strategies, or policies, open access by default to research data and other digital objects relevant to publicly funded research should be encouraged and supported. To the greatest extent possible, such access should be:\n(a) timely, findable, easy to use, and accessible online;\n(b) supported by regular curation and maintenance to prevent obsolescence of data formats and software design and implementation;\n(c) provided without discrimination regarding the user\u2019s location or nationality;\n(d) free of charge.<\/p>\n<h2>Rights of Personal Data Subjects<\/h2>\n<p>Data subjects may exercise the following rights, within the limits established by law:<\/p>\n<ul>\n<li><strong>right of access: <\/strong>the data subject has the right to obtain confirmation from FCT (as data controller) as to whether their personal data is being processed, as well as to access that data and request information about its processing.<\/li>\n<li><strong>right to rectification:<\/strong> the data subject has the right to obtain the rectification of inaccurate personal data and to have incomplete data completed.<\/li>\n<li><strong>right to erasure:<\/strong>the data subject has the right to obtain the deletion of their personal data, without prejudice to legally established retention periods.<\/li>\n<li><strong>right to restriction of processing:<\/strong> the data subject has the right to obtain restriction of processing.<\/li>\n<li><strong>right to data portability:<\/strong> the data subject has the right to receive the personal data concerning them, processed within the SciPROJ project, in a structured, commonly used, and machine\u2011readable format, and also to have that data transmitted directly to another controller.<\/li>\n<li><strong>right to object:<\/strong>\u202f the data subject has the right to object, at any time and on grounds relating to their particular situation, to the processing of personal data concerning them, including profiling. FCT will cease processing unless it demonstrates compelling legitimate grounds that override the interests, rights, and freedoms of the data subject, or for the establishment, exercise, or defense of legal claims.<\/li>\n<li><strong>right to withdraw consent:<\/strong> the data subject has the right to withdraw consent at any time, provided that the processing is based on consent and no other legal basis applies.<\/li>\n<li><strong>right to lodge a complaint:<\/strong>the data subject has the right to lodge a complaint with the Portuguese Data Protection Authority (Comiss\u00e3o Nacional de Prote\u00e7\u00e3o de Dados \u2013 CNPD) at(<a href=\"http:\/\/www.cnpd.pt\">www.cnpd.pt<\/a>) if they believe any of their rights have been violated.<\/li>\n<\/ul>\n<h2>Processors<\/h2>\n<p>For the processing of personal data, FCT may rely on third\u2011party service providers acting as processors, with access to the personal data of the respective users.<\/p>\n<p>Processors acting on behalf of FCT are required to provide written guarantees of their ability to implement appropriate technical and organizational measures to ensure compliance with the applicable privacy and personal data protection legislation and to safeguard the rights of data subjects. These guarantees are formalized in a contract signed between FCT and each of these third\u2011party entities.<\/p>\n<h2>Disclosure of Personal Data to Third Parties<\/h2>\n<p>Personal data is transmitted to third parties, specifically to other systems (organizations\/entities) within the national scientific ecosystem, and the transmitted data is processed for the same purpose.<\/p>\n<p>Only personal data originating from other publicly accessible systems is shared with third parties.<\/p>\n<p>Access to the data is granted through the creation of institutional access credentials and following a formal request submitted by the third\u2011party entities, which must first acknowledge this Privacy Policy and commit to processing the data in a manner that ensures its security. This includes protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, through the adoption of appropriate technical and organizational measures.<\/p>\n<h2>Transfer of Data to Third Countries<\/h2>\n<p>In strict compliance with the purposes set out in this Privacy Policy, FCT may rely on service providers located in third countries (outside the European Union or the European Economic Area), specifically for the hosting and storage of personal data.<\/p>\n<p>In this context, it is ensured that such entities comply with adequate security measures to guarantee the confidentiality and protection of personal data, in accordance with applicable data protection legislation. These measures include ensuring confidentiality (with encryption of data at rest and in transit using HTTPS), integrity, and availability of the data, as well as protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage.<\/p>\n<h2>Retention Period<\/h2>\n<p>The retention period for personal data is the one established by legal or regulatory provisions or, in their absence, the period necessary to fulfil the purpose for which the data was collected and processed.<\/p>\n<p>Data is stored in a manner that allows the identification of data subjects only for the period required for the purposes for which it is processed. Personal data may be retained for longer periods when processed exclusively for archiving in the public interest, scientific or historical research, or statistical purposes, in accordance with Article 89(1) of the GDPR, subject to the implementation of appropriate technical and organizational measures to safeguard the rights and freedoms of data subjects, including data minimization and pseudonymization.<\/p>\n<h2>Security Measures Adopted to Ensure the Protection of Personal Data<\/h2>\n<p>To ensure the protection of personal data, FCT implements strict and internationally recognized rules applicable to all individuals who legally handle personal data.<\/p>\n<p>Accordingly, technical and organizational security measures are implemented to protect the personal data made available to FCT, as well as the confidentiality, integrity, and authenticity of the data processed.<\/p>\n<p>The SciPROJ repository is based on the CERIF (Common European Research Information Format) and OpenAIRE (Open Access Infrastructure for Research in Europe) models, developed to describe research activity in a flexible manner, promoting interoperability between information systems and, consequently, the sharing and reuse of data, in line with the FAIR principles (Findable, Accessible, Interoperable, Reusable).<\/p>\n<p>Designed according to the Privacy by Design principle, both the CERIF data model and the OpenAIRE profile establish a standardized format for information sharing, promoting by default the minimization of stored data and pseudonymization.<\/p>\n<p>FCT continuously reviews the information quality and security practices it adopts, both to ensure ongoing improvement and to keep pace with emerging cyber threats by implementing the necessary countermeasures.<\/p>\n<h2>Notification and Complaints<\/h2>\n<p>Without prejudice to direct notification to FCT through the contacts available at  <a href=\"https:\/\/www.fct.pt\/contactos\">https:\/\/www.fct.pt\/contactos<\/a>, data subjects may submit a complaint directly to the Portuguese Data Protection Authority (Comiss\u00e3o Nacional de Prote\u00e7\u00e3o de Dados \u2013 CNPD) at (<a href=\"http:\/\/www.cnpd.pt\">www.cnpd.pt<\/a>), using the contact channels provided by that entity.<\/p>\n<h2>Changes to the Privacy Policy<\/h2>\n<p>This Privacy Policy may be updated, and regular consultation is therefore recommended.
